Starting a dietitian private practice in Florida
Florida licenses dietitians, nutritionists and nutrition counselors through the Department of Health's Dietetics and Nutrition Practice Council. Florida's telehealth law includes a registration path for out-of-state providers, and its breach law sets a 30-day notice deadline.
Credential: Licensed Dietitian/Nutritionist, regulated by the Dietetics and Nutrition Practice Council (Department of Health)
Official source: Florida Department of Health — Dietitian & Nutritionist
Credential and scope
- The Council licenses dietitians, nutritionists and nutrition counselors; licenses renew biennially, according to the Department of Health.
- Applicants with a current CDR credential can apply by examination waiver, per the Department's licensure page.
Telehealth across state lines
- Section 456.47, F.S. covers telehealth by practitioners licensed under part X of chapter 468 (dietetics and nutrition) and by out-of-state providers who register and comply with subsection (4).
Privacy and data breaches
- The Florida Information Protection Act (s. 501.171, F.S.) requires notice to affected individuals no later than 30 days after a breach is determined or reasonably suspected; personal information includes medical history, condition, treatment or diagnosis.
- Use a client portal or encrypted email for intake forms rather than plain email attachments.
Every state
Federal rules apply in every state too: the No Surprises Act generally requires a Good Faith Estimate for uninsured or self-pay clients, and HIPAA applies if you transmit health information electronically in connection with standard transactions such as insurance billing. Also check whether your state has joined the Dietitian Licensure Compact before seeing clients across state lines.
